Infinity Background – Terms of Service

Welcome to Infinity Background (“Infinity Background,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of www.infinitybackground.com, our platform, and any related services, applications, or features (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You may use the Services only if:

  • You are at least 18 years of age;

  • You have the authority to enter into binding agreements; and

  • Your use of the Services complies with all applicable laws, including federal, state, and local regulations governing background screening, employment decisions, and consumer reporting.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Our Services

Infinity Background provides tools enabling employers, businesses, organizations, and authorized users to:

  • Submit background check orders

  • Collect applicant information

  • Integrate with third-party screening providers (e.g., Affirm, ClearA, and others)

  • Retrieve background check results

  • Manage compliance-related workflows (including adverse action)

Infinity Background is not a Consumer Reporting Agency (“CRA”) as defined under the Fair Credit Reporting Act (“FCRA”). Third-party vendors that provide screening data may be CRAs, and their terms may apply to you separately.

3. User Responsibilities

You agree that you will:

  • Only submit information you are authorized to provide

  • Obtain all legally required permissions and disclosures from applicants

  • Comply with all federal, state, and local regulations, including:

    • FCRA

    • Equal Employment Opportunity Commission (EEOC) guidance

    • State background screening laws

  • Use the Services solely for legally permissible purposes

You may not:

  • Use the Services for personal background checks

  • Use data obtained through the Services to discriminate unlawfully

  • Attempt to circumvent security, access other users’ data, or misuse the platform

  • Submit false, misleading, or incomplete information

4. Third-Party Vendors

Infinity Background integrates with third-party vendors to fulfill background checks (“Screening Vendors”). These include but are not limited to:

  • Affirm Data

  • ClearA

  • Additional services or partners as integrated in the future

You acknowledge and agree:

  • Screening Vendors are responsible for the accuracy and legality of the reports they provide.

  • Screening Vendor delays, errors, outages, or data issues are not the responsibility of Infinity Background.

  • Your use of Screening Vendor services may be subject to their own terms and conditions.

5. Account Registration and Security

To use certain features, you must create an account. You agree that you will:

  • Provide accurate registration details

  • Keep your credentials secure

  • Notify us immediately of any unauthorized access

We are not liable for any loss or damages arising from unauthorized account activity unless caused by our negligence.

6. Fees and Payments

Fees for background checks, subscription plans, or usage-based charges will be presented during onboarding or checkout. You agree to:

  • Pay all applicable fees

  • Maintain valid payment information

  • Accept that all fees are non-refundable unless required by law

Infinity Background may modify pricing with notice.

7. Compliance With FCRA and State Laws

If you use the Services to obtain background checks for employment purposes, you are responsible for:

  • Providing FCRA-compliant disclosures and authorizations

  • Giving applicants appropriate notices (pre-adverse and adverse action)

  • Following proper dispute handling procedures

  • Making decisions based on legal guidelines and fair practices

Infinity Background may provide tools to help with compliance, but you remain legally responsible for fulfilling all FCRA and related obligations.

8. Data Privacy

Your use of the Services is governed by our Privacy Policy, which explains:

  • What data we collect

  • How we use it

  • How we store and protect it

We take commercially reasonable steps to secure data but cannot guarantee absolute security.

9. Intellectual Property

All content, software, branding, designs, and materials within the Services are the property of Infinity Background or our licensors. You may not:

  • Copy or redistribute website content

  • Reverse engineer our code

  • Remove copyright or trademark notices

Infinity Background grants you a limited, revocable license to use the Services in accordance with these Terms.

10. Prohibited Activities

You may not use the Services to:

  • Engage in fraud or identity misuse

  • Conduct background checks without proper authorization

  • Harvest or scrape information from the site

  • Upload malicious code

  • Interfere with the operation of the platform

We may suspend or terminate accounts violating these Terms.

11. Service Availability and Disclaimer

The Services are provided “as is” and “as available”. We do not guarantee:

  • Continuous uptime

  • Error-free operation

  • Timely delivery of third-party data

  • Accuracy or completeness of vendor reports

INFINITY BACKGROUND DISCLAIMS ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Limitation of Liability

To the fullest extent allowed by law:

  • Infinity Background is not liable for damages arising from your use of the Services, including lost profits, lost data, or business interruption.

  • Our total liability shall not exceed the amount paid by you to Infinity Background in the six months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Infinity Background and its officers, employees, agents, and affiliates from any claims, damages, losses, or expenses arising from:

  • Your misuse of the Services

  • Your violation of laws related to background screening

  • Your breach of these Terms

  • Your decisions, hiring practices, or adverse action processes

14. Termination

We may suspend or terminate your access to the Services at any time if:

  • You violate these Terms

  • We believe your actions pose a security or legal risk

  • You fail to pay required fees

You may cancel your account at any time. Termination does not relieve outstanding payment obligations.

15. Changes to the Terms

We may update these Terms periodically. Material changes will be posted on our website or emailed to you. Continued use of the Services after changes constitutes acceptance.

16. Governing Law
